Terms and Conditions – The English Take
1. Definitions
1.1 In these Terms and Conditions, the following words have the associated meanings:
“The English Take”, “we”, “us”, “our” means The English Take, a self-employed business registered in Belgium. Registered business address available upon request for legal or administrative purposes only.
“Student”, “you”, “your” means any individual using the Website and/or purchasing or participating in lessons offered by The English Take.
“Website” means www.englishtake.com.
“Services” means the online, one-to-one English lessons provided by The English Take, including access to lesson materials (partially created by The English Take and partially based on Speakout coursebooks), and any other services provided via the Website.
2. Registration and Account
2.1 No account is required to book lessons. Students book lessons directly via the booking system on the Website.
2.2 All booking information is handled by the booking system. The English Take does not collect or store sensitive payment or personal data beyond what is necessary for lesson scheduling (student name).
2.3 Students are responsible for keeping any booking confirmation or links secure. Sharing lesson links or access with others is strictly prohibited.
3. Scope of Lessons
3.1 All lessons are conducted strictly online and on a one-to-one basis.
3.2 All lessons are conducted in English only.
3.3 Lessons are not recorded by The English Take. Students are strictly prohibited from recording lessons in any form.
3.4 Materials used in lessons:
Are partially created by The English Take and partially based on Speakout coursebooks.
Are provided only for use by the student in the lesson.
May not be shared, copied, or redistributed outside of the lesson.
Only materials actively used or discussed during a lesson may be shared with the student via Google Drive.
3.5 Age and supervision rules:Students under 6 years old are not accepted.
Students aged 6–8: lessons max 30 minutes per day, parent or guardian must be physically present in the room.
Students aged 9–13: lessons max 60 minutes per day, parent or guardian must be physically present in the room.
Students over 13: no time restrictions.
Supervision does not require participation, only presence in the room.
3.6 The English Take reserves the right to refuse service to any student violating these rules or behaving inappropriately.
4. Payment and Prepayment
4.1 All lessons must be prepaid. Payment is handled exclusively via the website booking system.
4.2 If payment cannot be processed through the booking system, the student must provide proof of payment via email (learn@englishtake.com) prior to the lesson.
4.3 VAT will be added at checkout where applicable.
4.4 The English Take is registered in Belgium. VAT number BE1025.223.880 will be applied to all invoices where applicable.
4.5 Students are responsible for providing accurate payment information to ensure successful processing.
5. Cancellation and Rescheduling
5.1 Students may cancel or reschedule lessons only if 24 hours or more notice is given via the booking system or email.
5.2 Cancellations or rescheduling less than 24 hours in advance are not permitted and are non-refundable.
5.3 The English Take may cancel lessons at any time. In such cases, the student will receive either a full refund or a free reschedule.
5.4 No refunds will be issued for missed lessons, late attendance, or technical issues on the student’s side.
6. Refusal of Service
6.1 The English Take reserves the right to refuse service to any student, including but not limited to:
Students under 6 years old.
Multiple students booking a single lesson.
Students who violate these Terms, misbehave, or pose safety, legal, or ethical concerns.
7. Technical Limitations
7.1 The English Take is not responsible for technical issues on the student’s side, including poor internet, device malfunctions, or software errors, that may affect lesson quality.
7.2 If a lesson cannot be conducted due to technical issues on the teacher’s side, a full refund or free reschedule will be provided.
8. Student Obligations and Learning Outcomes
8.1 Students are expected to actively participate in lessons.
8.2 The English Take does not guarantee improvement in language skills, passing of exams, or achievement of specific learning goals.
8.3 Results depend on independent study and participation; students bear responsibility for their own learning.
8.4 Exam prep lessons do not guarantee passing exams, and The English Take is not liable for exam failure.
9. Data Collection and Storage
9.1 The only personal data collected by The English Take is the student’s name.
9.2 Students receive a Google Drive link for lesson materials.
9.3 Google Drive links and materials will be deleted after 3 months of inactivity (no lessons taken).
9.4 Students may download materials from the Drive but may not redistribute them.
9.5 No other personal data is collected.
9.6 By using the Services, students consent to the collection and use of their data solely for lesson delivery and communication purposes.
10. Updates to Terms
10.1 The English Take reserves the right to update or modify these Terms at any time.
10.2 Updated Terms will be published on the Website.
10.3 Continued use of the Website or services after updates constitutes acceptance of the new Terms.
11. Use of the Website and Content
11.1 By using the Website, students agree that all Website Terms apply to their use of the site.
11.2 Students may not post public comments or share content that infringes copyright or contains harmful material.
11.3 Students may not share links to protected assets, including images, videos, or lesson materials.
11.4 All content on the Website and lesson materials is protected by copyright laws.
11.5 Unauthorized distribution, copying, or commercial use of content is strictly prohibited.
11.6 The English Take reserves all rights to its content.
11.7 Students may report copyright infringement via email at learn@englishtake.com.
12. Limitation of Liability
12.1 The English Take is not responsible for technical issues on the student’s side.
12.2 Refunds are provided only if lessons cannot be conducted due to technical issues on the teacher’s side.
12.3 Maximum liability in the event of a dispute is a refund for future pre-paid lessons canceled by The English Take.
12.4 No refunds are issued for lessons in which a dispute occurs or during which the issue happened.
13. Governing Law and Dispute Resolution
13.1 These Terms are governed by Belgian law.
13.2 Any legal disputes shall be resolved in the courts of Belgium.
13.3 In case of a disagreement, The English Take may refuse further service or end a lesson early without refund.
13.4 Refunds are provided only for future lessons canceled due to a dispute.
14. Acceptance of Terms
14.1 By booking a lesson via the Website, students confirm that they have read, understood, and agree to these Terms and Conditions.
14.2 Students acknowledge that all rules regarding booking, payments, cancellations, materials, and website use apply to their lessons.
